In accordance with UK data protection law (UK GDPR and Data Protection Act 2018), the Customer has, at any time, a right of access, rectification, objection, erasure and portability of their personal data by writing, with proof of identity, to the Seller's address above.
Confirmation of the order by the Customer constitutes unreserved acceptance of these Terms and Conditions of Sale.
The Customer acknowledges having the legal capacity required to enter into a contract and purchase the Products offered on the wentworthsons.co.uk website.
5-1. Placing an order It is up to the Customer to select the Products they wish to order on the wentworthsons.co.uk website.
The Customer can check the details of their order and its total price, and correct any errors, before confirming acceptance. It is the Customer's responsibility to check the accuracy of the order and to report or correct any errors immediately.
An order is recorded on the wentworthsons.co.uk website when the Customer accepts these Terms and Conditions of Sale by ticking the relevant box and confirms their order. This confirmation implies acceptance of these Terms and Conditions of Sale in full, as well as the general terms of use of the website.
The sale is final only once the Seller has sent the Customer confirmation of acceptance of the order by email, which will be sent without delay after full payment has been received.
Any order placed, confirmed by the Customer and accepted by the Seller under the conditions described above constitutes the formation of a distance contract between the Customer and the Seller.
Unless proven otherwise, data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding payment of a previous order.
The Seller does not sell Products on the wentworthsons.co.uk website to trade buyers, but only to consumers or non-professionals, for their personal needs. The Seller therefore reserves the right to refuse orders of the same Product in large quantities exceeding 10 items.
5-2. Order amendments Any amendments requested by the Customer can only be taken into account by the Seller within the limits of its capabilities and provided they are notified by email to support@wentworthsons.co.uk at least 2 days before the scheduled dispatch date.
If such amendments cannot be accepted by the Seller, any sums paid by the Customer when placing the order will be refunded within 14 days of notification that the requested amendments cannot be accepted (unless the Customer prefers a credit note or exchange).
5-3. Cancellation of an order Orders may be cancelled by the Customer, outside the exercise of the right to cancel or in the event of force majeure, at least 2 days before the scheduled delivery date, at no cost to the Customer.
Products are supplied at the prices in force on the wentworthsons.co.uk website when the order is recorded by the Seller. Prices are expressed in Pounds Sterling (GBP), inclusive of VAT where applicable.
Prices take into account any discounts granted by the Seller on the website.
These prices are fixed and non-revisable during their period of validity, as indicated on the website; outside this period, the Seller reserves the right to change prices at any time. Prices include processing, packing, shipping and delivery costs.
The amount charged to the Customer corresponds to the total purchase amount, including these costs.
The price is payable in full on the day the Customer places the order, by secure payment, using the following methods:
By debit or credit card: Visa, Mastercard, American Express, Maestro
Payment by card is irrevocable, except in the event of fraudulent use of the card. In this case, the Customer may request cancellation of the payment and reimbursement of the corresponding amounts.
Products ordered by the Customer will be delivered within the United Kingdom.
Orders are dispatched within 24 to 48 hours, and delivered within an average of 5 to 10 business days from dispatch, to the address provided by the Customer when ordering on the website.
Delivery is deemed to take place when the Product is physically handed over to, or its control is transferred to, the Customer. Except in special cases or where one or more Products are unavailable, ordered Products will be delivered in a single shipment.
The Seller undertakes to use its best efforts to deliver the Products ordered by the Customer within the timeframes stated above. However, these timeframes are given for guidance only. If the Products ordered have not been delivered within 30 days of the indicative delivery date, for any reason other than force majeure or the Customer's own actions, the sale may be cancelled at the Customer's written request in accordance with the Consumer Rights Act 2015. Sums paid by the Customer will then be refunded within 14 days of the date the contract is terminated, with no deduction or compensation.
In the event of non-conformity of the delivered Product, the Seller undertakes to remedy this or refund the Customer, as set out in the "Seller's liability - Warranty" article.
The Seller bears the risks of transport and undertakes to reimburse the Customer in the event of damage caused during transport.
Ownership of the Products transfers from the Seller to the Customer only once the price has been paid in full, regardless of the delivery date of the Products.
Regardless of the date ownership transfers, the risk of loss or damage to the Products transfers only once the Customer takes physical possession of them. Products therefore travel at the Seller's risk.
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer has a period of fourteen days from receipt of the Product to exercise their right to cancel with the Seller, without having to give any reason or pay any penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within fourteen days of notifying the Seller of the decision to cancel.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.), allowing them to be resold as new, together with proof of purchase. Damaged, soiled or incomplete Products will not be accepted.
The right to cancel may be exercised online, using the cancellation form available on the wentworthsons.co.uk website, in which case an acknowledgement of receipt on a durable medium will be sent immediately to the Customer by the Seller, or by any other unambiguous statement expressing the wish to cancel.
If the right to cancel is exercised within the above period, only the price of the Product(s) purchased and the standard delivery costs will be refunded; return costs remain the Customer's responsibility.
The refund will be made within 14 days of the Seller receiving the returned Product or evidence that it has been sent back, whichever is earlier.
Products sold on the wentworthsons.co.uk website comply with applicable UK regulations and are suitable for non-professional use.
Products supplied by the Seller benefit, as of right and at no additional cost, independently of the right to cancel, from the statutory rights set out in the Consumer Rights Act 2015, including the right for goods to be of satisfactory quality, fit for purpose, and as described.
Under the Consumer Rights Act 2015, if a fault is found within 30 days of purchase, the Customer is entitled to a full refund. Beyond 30 days, and up to six months, the Customer is generally entitled to a repair or replacement, and if that is not possible, a refund. The Seller will remedy any non-conforming or defective Products or parts under warranty by repair, replacement or refund. Outbound delivery costs will be refunded based on the standard rate charged, and return costs will be refunded on production of proof.
Refunds for Products found to be non-conforming or defective will be made as soon as possible, and in any event within 14 days of the Seller confirming the defect. Refunds will be made by crediting the Customer's bank account or original payment method.
The Seller's liability cannot be engaged in the following cases:
failure to comply with the law of the country to which the products are delivered, which it is the Customer's responsibility to check,
misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, as well as normal wear and tear, accident or force majeure.
The Seller's warranty is, in any event, limited to the replacement or refund of non-conforming or defective Products.
The personal data requested from the Customer is necessary for processing their order and issuing invoices, among other things. This data may be shared with the Seller's partners responsible for order fulfilment, processing, management and payment.
The processing of information submitted via the wentworthsons.co.uk website complies with legal requirements regarding the protection of personal data, in accordance with the UK GDPR and the Data Protection Act 2018.
The Customer has, in accordance with applicable regulations, an ongoing right of access, modification, rectification, objection, portability and restriction of processing regarding information concerning them. This right may be exercised under the conditions and in the manner set out on the wentworthsons.co.uk website.
The content of the wentworthsons.co.uk website is the property of the Seller and its partners and is protected by applicable intellectual property law. Any full or partial reproduction of this content is strictly prohibited and may constitute infringement, passing off and unfair competition.
The Parties cannot be held liable if the non-performance or delay in performance of any of their obligations described herein results from a case of force majeure, within the ordinary legal meaning of that term.
These Terms and Conditions of Sale, and the transactions arising from them, are governed by the laws of England and Wales. They are drafted in English.
Any dispute arising from purchase and sale transactions concluded under these Terms and Conditions of Sale, concerning their validity, interpretation, performance, termination, consequences and aftermath, which cannot be resolved between the Seller and the Customer, will be submitted to the competent courts of England and Wales.
The Customer is informed that they may, in any event, seek independent advice from Citizens Advice or their local Trading Standards service in the event of a dispute. Wentworth & Sons does not currently participate in a certified Alternative Dispute Resolution (ADR) scheme.
The fact that a natural (or legal) person places an order on the wentworthsons.co.uk website implies full and complete acceptance of these Terms and Conditions of Sale and the obligation to pay for the Products ordered, which is expressly acknowledged by the Customer, who waives the right to rely on any contradictory document that would not be binding on the Seller.
Under the Consumer Rights Act 2015, goods supplied under a contract must be of satisfactory quality, fit for any particular purpose made known to the trader, and as described.
If goods do not conform to the contract, the Customer may be entitled, depending on the circumstances and how soon the fault is discovered, to a repair, a replacement, a price reduction, or a refund, and in some cases to reject the goods for a full refund within 30 days of purchase.
These statutory rights are in addition to, and are not affected by, any commercial guarantee that may cover the Product.
This form should only be completed and returned if the Customer wishes to cancel an order placed on wentworthsons.co.uk, subject to any exclusions or limits on the right to cancel under the applicable Terms and Conditions of Sale.
